Ensuring the security of personal data is one of our top priorities. Therefore, ACCIONA commits to processing personal data in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data („GDPR”).

This Privacy Policy applies to all users, i.e. visitors to our website, as well as any other person who provides us with personal information through various communication channels ("User" or "Users"). Communication Channels are understood to be the websites, applications, platforms, mailboxes, telephone numbers, social network profiles, and forms made available to Users by ACCIONA to enable communication with us, as well as to provide information about our activities

References to "ACCIONA", and terms such as "we", "us" and "our" in this Privacy Policy refer to the Controller responsible for processing Users’ personal data.

Some of our Communication Channels may contain links to other websites and applications not owned by ACCIONA. This Privacy Policy does not apply to them.

ACCIONA applies the technical and organizational measures necessary to ensure the security of personal data and to prevent alteration, loss, unauthorized processing or access to such data, taking into account the state of knowledge, the nature of the data and the danger to which it is exposed. Users can verify the presence of an SSL certificate by hovering over the closed padlock symbol in the browser bar. The connection is secure when “https://” appears in the browser’s address bar instead of “http://”, along with a closed padlock symbol.

  4. For the purposes of this Privacy Policy, the term "personal data" refers to any information that identifies Users directly or indirectly.

    The personal data of Users obtained through Communication Channels, including this website, may only be collected if it is adequate, relevant, and not excessive in relation to the specific, explicit, and lawful purpose for which it was collected.

    Users are solely responsible for the information provided and for its truthfulness and legality.

  7. TO WHOM MAY ACCIONA TRANSFER USER DATA?
  8. ACCIONA undertakes not to transfer or disclose Users’ personal data except as described in this Privacy Policy or indicated separately at the data collection stage. If necessary, the data may be transferred to:

    • ACCIONA Group companies;
    • ACCIONA’s service recipients. When required by the provisions of the GDPR, the Controller signs entrustment agreements for the processing of personal data with its service recipients;
    • entities entitled to receive it under applicable law, including competent judicial authorities. The Controller shall transfer the collected personal data to government, law enforcement, and judicial authorities upon their express request and only in cases specified by law;
    • third parties in the event of an actual or potential transfer or sale of all or part of our business (including in the event of a merger, acquisition, joint venture, restructuring, assignment, dissolution, or liquidation).

     
  9. SOCIAL NETWORKS
  10. ACCIONA uses social networks such as LinkedIn, Facebook, Google+, Instagram, YouTube, and Pinterest to inform Users about the Controller’s activities and to promote various events, services, and products. The legal basis for the Controller’s processing of Personal Data for this purpose is its legitimate interest (Article 6(1)(f) of the GDPR), which consists in promoting its own brand and the content of ACCIONA Group companies. On these platforms, we act as the controller responsible for the data we publish, always processing it in accordance with the provisions of the GDPR and the terms and conditions established by these social networks.

    Interaction with Users through social networks may involve the international transfer of analytical and technical data with respect to a particular social network. Data transfers to countries outside the European Economic Area are carried out with appropriate security measures, in particular secured by Standard Contractual Clauses.

    Our website may contain links to other websites. When a User clicks on such a link, leaves our site and goes to another site, they must be aware that we have no control over the site to which the link redirects. Therefore, we cannot be held responsible for protecting the User’s privacy and the data they provide when visiting another site.


     
  11. CONTESTS
  12. If we organize a contest or contests, details regarding the processing of participants’ personal data will be outlined in the relevant contest rules, which the user should read before participating.
  13. COMMUNICATION OF COMMERCIAL INFORMATION
  14. ACCIONA does not provide Users with commercial information without obtaining their prior express and informed consent. Any User may revoke their consent at any time and thereby opt out of receiving commercial information, as well as object to the future processing of personal data, by sending us an e-mail or using the appropriate “unsubscribe” or similar option provided in the method of communication chosen by the User.
     

  15. AUTOMATED DECISIONS
  16. ACCIONA does not automate decision-making processes or create any profiles of Users. 

  17. WHAT RIGHTS DO USERS HAVE IN RELATION TO THE PROCESSING OF PERSONAL DATA?
  18. Users have the right to access, rectify, erase, transfer, limit processing, and object to the processing of their data. In addition, Users may at any time withdraw their consent to the processing of personal data, if previously given, or file a complaint with the supervisory authority responsible for personal data protection, i.e. the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw. Users can exercise the aforementioned rights in particular by contacting us by e-mail at privacy.poland@acciona.com. We may request identifying information from users as part of the verification process.

    ACCIONA reserves the right to amend the Privacy Policy. We may update this Privacy and Cookie Policy and any other specific privacy statement. A new date will be added to this Privacy Statement whenever changes are made to this Privacy and Cookie Policy. The update will not lower data protection standards, unless required by applicable law.
